JUDGMENT
(Judgment of the Court was made by N.SATHISH KUMAR, J.) Challenging the order made in W.P(MD)No.31295 of 2025 dated 05.11.2025, the Education Department has filed this appeal.
2. The 1st respondent was appointed as a Secondary Grade Teacher in the 3rd respondent school on 05.06.1996. He underwent Child Pshychology course from 02.05.2003 to 31.05.2003 and on completion of the same, the 1st respondent's appointment was approved. The 1st respondent attained the age of superannuation on 31.05.2003. While the school sent proposal for terminal benefits to count the service of the 1st respondent rendered prior to the child psychology training from the date of his initial appointment for the purpose of calculating the benefits of selection grade and special grade, it was returned by the appellants. Challenging the same, the 1st respondent filed writ petition. 2/5
3. The learned Single Judge ordered the writ petition, taking note of the judgment of the Division Bench in this regard, namely, State of Tamil Nadu, rep. by its Secretary and others vs, Pallivasal Primary School, rep.by its Correspondent reported in 2002 (2) LW 591.
4. It is relevant to note that the said judgment has reached finality and in the said judgment, the issue was clearly held that the past service shall be calculated for the pension. Later, another Division Bench, in W.A(MD)No.1464 of 2021, vide order dated 28.07.2021 in the case of District Elementary Educational Officer, Tirunelveli and others vs, M.S.Shanthi and others, has also followed the Pallivasal Primary School's case.
5. In such view of the matter, as the past service is ordered to be counted for pension, we do not find any infirmity in the order of the learned Single Judge. Hence, the Writ Appeal is dismissed.
