ORDER

The petitioner has filed this criminal original petition, under Section 482 of the Code of Criminal Procedure, seeking direction upon the respondent Police to register a case, based on his complaint, dated 28.12.2015.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents.

3. On reading of the complaint, dated 28.12.2015, it is seen that the petitioner is the owner of a Truck bearing registration No.TN10 W5716 and on the request of M/s.Sri Krishna Lorry Service, Marg Port, Karikal, he provided the Truck for transportation of Pet Coke from Marg Port, Karaikal to Dalmia Cements Bharat Ltd., Trichy. The grievance of the petitioner is that even after unloading of the consignment, his Truck has not been returned to him.

4. This Court does not find any cognizable offence on the petitioner's complaint, dated 28.12.2015, to direct the respondent Police to register F.I.R. The petitioner has merely stated that his Truck has been retained by Dalmia Cements Bharat Ltd., Trichy, after unloading of the consignment. Under such circumstances, this criminal original petition is dismissed. However, the petitioner is at liberty to work out his remedy in the manner known to law.
