RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition para(7) in Crl.OP(MD)No.6137 of 2022 dt.20/4/2022 on the file of this Honble Court. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.GUNASEKARAN C, Advocate for the petitioners and of MR.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- This petition has been filed seeking orders to modify the conditions imposed by this Court in Crl.O.P.(MD)No.6137 of 2022, dated 20.04.2022, wherein, this Court has directed the petitioners to deposit a sum of Rs.
15,000/-each to the credit of Government of Tamil Nadu, CMPRF in IOB, Secretariat Branch, Chennai-9 (Account No.11720 10000 00070, IFSC Code: IOBA0001172), without prejudice to their rights and contentions before the trial Court and produce the receipt/acknowledgment before the learned Judicial Magistrate, Melur, Madurai District.
2.The learned counsel for the petitioners would submit that the case was registered in Crime No.24 of 2022 for the offence under Sections 109, 147, 148, 294(b), 307, 323, 324, 341, 427, 506(2) and 379 NP of IPC. CRL MP(MD) No.6260 of 2022 further submit that the petitioners are coolie workers and they are not in a position to deposit the amount as directed by this Court. 3.The leared Government Advocate (Criminal Side) appearing for the State would submit that the damaged cellphone was valued at Rs.15,000/-.
4.Considering the facts and circumstances and also the submissions made by the learned counsel for the petitioners, this Court is inclined to modify the condition and the petitioners are directed to deposit a sum of Rs.10, 000/- each to the credit of Government of Tamil Nadu, CMPRF in IOB, Secretariat Branch, Chennai9 (Account No.11720 10000 00070, IFSC Code: IOBA0001172) without prejudice to their rights and contentions before the trial Court and produce the receipt/acknowledgment before the learned Judicial Magistrate, Melur, Madurai District within a period of two weeks from the date of receipt of copy of this order. 5.With the above modification, this petition is disposed of. sd/- 13/06/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
