Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Respondents to consider the Petitioners representation dated 14.11.2025 and 02.12.2025 and pass appropriate order in accordance with law on merits, by conducting a comprehensive administrative and financial Enquiry, Audit, and taking appropriate action against the erring management of M/s. Raja Higher Secondary School, No.48, Theater Road, Ettayapuram Town and Taluk, Thoothukudi District, within a time stipulated by this Honble Court and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER
The writ petition is filed directing the respondents to consider the Petitioner's representation dated 14.11.2025 and 02.12.2025 and pass appropriate orders in accordance with law on merits by conducting a comprehensive administrative and financial Enquiry, Audit and taking appropriate action against the erring management of M/s.Raja Higher
Secondary School, No.48, Theatre Road, Ettayapuram Town and Taluk, Thoothukudi District within the time stipulated by this Court.
2. Heard Mr.P.M.Vishnuvarthanan, learned counsel appearing for the petitioner and Mr.N.Ramesh Arumugan, learned Government Advocate, who takes notice for R1 to R6 and Mr.C.Nihil Nandha, learned counsel who takes notice for R7.

It is the case of the petitioner that he is claiming himself to be a family member of T.M.K.Raja, Ettayapuram Zamin and an interested person with reference to the protection of the heritage, legacy and proper administration of M/s.Raja Higher Secondary School, Ettayapuram has come up with the present writ petition.
4. Upon perusal of his representations dated 14.11.2025 and 02.12.2025, it can be seen that he has made several allegations against the school agency stating that there is misappropriation of funds, non-utilization of proper infrastructure etc.
5. When the matter came up for hearing today, the learned Government Advocate appearing on behalf of the respondents 1 to 6 would submit that the 5th respondent will conduct an enquiry and orders will be passed in the manner known to law.
6. The learned counsel appearing on behalf of the 7th respondent would submit that the petitioner was removed from the management of this school. All the allegations mentioned in the representations are false and the school is properly run by the present Secretary. As a matter of fact, pursuant to the representations made by the petitioner, an inspection has been conducted by the 5th respondent.
7. I have considered the rival submissions made on either side and perused the material records of the case.
8. The writ petition is disposed of at the admission stage itself without expressing any opinion on the merits of the matter.
9. Since the petitioner is said to have made representations with reference to the mismanagement of the school, the allegations be considered by the 5th respondent in the manner known to law and an order in writing shall be passed after conducting enquiry as expeditiously as possible. Needless to mention that It will also be open for the 7th respondent to plead before the 5th respondent as to the motives of the petitioner also.
10. In view thereof, this writ petition is ordered on the following terms:- i. The 5th respondent is directed to take up the representation submitted by the petitioner dated 14.11.2025 and 02.12.2025 and conduct enquiry and thereafter, pass a final orders in accordance with law, after issuing due notice both to the petitioner and the 7th respondent.
ii. The said exercise shall be completed within a period of four months from the date of receipt of a web copy of the order, without waiting for the certified copy of the order. iii. No costs. Consequently, connected miscellaneous petition is closed.
