ORDER

This Criminal Original Petition has been filed to withdraw the petitioner's complaint, dated 03.03.2023 on the file of the 3rd respondent and entrust the same to the 1st respondent or to some other Investigation Agency to nominate an officer not below the rank of Deputy Superintendent of Police, based on the petitioner's representation, dated 03.03.2023 for further investigation of the case.

2. The learned Additional Public Prosecutor would submit that the complaint was received by the third respondent police through 2/5

post on 03.03.2023. Except the complaint, the petitioner did not appear for the enquiry.

3. Before filing this petition, this petitioner ought to have approached the third respondent to ascertain the status. Without ascertaining the status of the complaint, filing of this petition is not proper stating that no steps have been taken by the third respondent. Let the petitioner be appeared before the third respondent for enquiry and that the third respondent is directed to complete the enquiry within a period of one month from the date of receipt of a copy of this order.

4. This Criminal Original Petition is disposed of accordingly.
