Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.3/2024 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.3 of 2024, for the offence punishable under Section 498 (A) IPC, has filed this petition seeking anticipatory bail.

2. The case of the prosecution is that due to matrimonial dispute, the 1/3

petitioner and his mother demanded Rs.5,00,000/- from the defacto complainant/wife of the petitioner. Hence, the case.

3. The learned counsel appearing for the petitioner submits that the petitioner has not demanded dowry from the defacto complainant. She used to find fault with the petitioner even for petty things. The petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submits that earlier, the petitioner has filed a petition in Crl.O.P(MD)No.4583 of 2024, seeking the very same relief and the same was dismissed by this Court. The petitioner is having affair with some other girl.

5. Considering the facts and circumstances of the case and also considering the fact that there is no change of cirucumstances, this Criminal Original Petition is dismissed.
