O R D E R

The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the respondent Bank to defreeze the petitioner's bank account bearing No. 074601000022290.

2. Mr. N. Dilip Kumar, learned counsel appearing for the respondent, accepts notice and, on instructions, submits that the petitioner's bank account has been frozen on the ground that a sum of Rs.11,861/- was fraudulently transferred to the said account.

3. I have considered the submissions made on either side.

4. It is not in dispute that the petitioner's bank account has been frozen on the allegation that a sum of Rs.11,861/- was fraudulently credited to the petitioner's account. In such circumstances, this Court is of the view that the ends of justice would be met if the petitioner is permitted to operate the bank account, subject to the respondent marking a lien for a sum of Rs.11,861/-.

5. Accordingly, the writ petition is allowed to the limited extent that the respondent Bank shall mark a lien for a sum of Rs.11,861/- in the petitioner's bank account and permit the petitioner to operate the account for the remaining balance. No costs.
