ORDER

The petitioner has filed this writ petition for a Mandamus, directing the respondents to permit him to run the eatery/hotel, namely Madurai Midnight Briyani, situated at Shop No.16, Fruit Market Complex, Melur Main Road, Mattuthavani, Madurai, everyday evening 6.00 p.m. to morning 5.00 a.m. based on his representation dated 01.04.2024.

The learned counsel appearing for the petitioner submits that the Government has passed a Government Order in G.O.(Ms)No.60, Labour and Employment (K2) Department, dated 28.05.2019 permitting all the shops and establishment in Tamil Nadu to keep open for 24 x 7 on all days of the year initially for a period of three years. By relying upon the said G.O., the learned counsel seeks for a direction 2/4

to the respondents to permit the petitioner to run the hotel, namely Madurai Midnight Briyani, everyday evening 6.00 p.m. to morning 5.00 a.m.

3. The G.O. referred by the petitioner is restricted only for a period of three years and that the period of three years was also over by 2022. Therefore, the relief sought for in this writ petition cannot be granted.

4. Accordingly, this writ petition is dismissed. No costs. 11.07.2024 ogy NCC : Yes / No.
