Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondent herein to permit the petitioner to conduct the Aadalum Padalum cultural program during the Arulmigu Sree Muthalamman Thirukovil, Dombucherry Temple festival on 29.11.2015 from 07.00 p.m., to 11.00 p.m.

ORDER

This Writ Petition has been filed, praying for issuance of a Writ of Mandamus, to direct the respondent herein to permit the petitioner to conduct the Aadalum Padalum cultural program during the Arulmigu Sree Muthalamman Thirukovil, Dombucherry Temple festival on 29.11.2015 from 07.00 p.m., to 11.00 p.m.

2. Mr.D.Muruganandham, learned Additional Government Pleader takes notice for the respondent.

3. The petitioner is the President of Arulmigu Sree Muthalamman Thirukovil, Dombucherry and they have decided to conduct the Temple festival along with some cultural programme on 29.11.2015. Therefore, he made a representation to the respondent Police on 18.11.2015 for giving protection and permission for conducting cultural programme. Since the representation has not been considered by the respondent Police, the petitioner has come forward with this present Writ Petition.

4. Mr.D.Muruganandham, learned Additional Government Pleader, on instructions, submitted that already there is a group clash between two rival groups in the Village and three cases have been registered against all of them. In these circumstances, if permission is granted to conduct Adal Padal programme, law and order problem will arise.

5. Considering the facts and circumstances of the case, without deciding the issue on merits, I direct the respondent/the Inspector of Police, Palanichettipatty Police Station, Palanichettipatty to consider the petitioner's representation, dated 18.11.2015 on its own merits and pass orders in accordance with law within a period of two weeks from the date of receipt of a copy of this order. No costs.
