Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to promote the petitioner from Road Inspector Grade II to Road Inspector Grade I on the basis of the representation given by the petitioner on 19.06.2018.

The petitioner has come forward with the present Writ Petition for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to promote the petitioner from Road Inspector Grade II to Road Inspector Grade I, on the basis of the representation given by the petitioner on 19.06.2018.
2. It is represented that a Writ Petition in W.P.(MD)No.5153 of 2015 is pending before this Court in which, this Court has passed an order on 8.04.2015, observing that any promotion is made, will be subject to the result of the writ petition. According to the petitioner, if there is any vacancy arisen, the petitioner can be considered for the future period, if the petitioner is otherwise eligible.
3. If the petitioner succeeds in the above Writ Petition in W.P.(MD)No.5153 of 2015, the petitioner will be placed above his juniors, who are parties in the aforesaid writ petition. Hence, the respondents are directed to consider the request of the petitioner for promotion, for the future date, without disturbing others, who are already promoted, if there are no legal impediments and if he is otherwise eligible, pass orders within a period of two months from the date of receipt of a copy of this order, in accordance with law.
4.With the above direction, the Writ Petition stands disposed of. No costs.
