O R D E R

Heard the learned counsel appearing for the petitioner and the learned Assistant Solicitor General of India appearing for respondents 1 and 2 and the learned Special Government Pleader appearing for the third respondent.

2. The petitioner seeks issuance of passport. Since a criminal case is pending against the petitioner, it was not being processed. The learned Special Government Pleader informs the Court that cognizance of the criminal case is yet to be taken.

3. Therefore, I will proceed on the premise that the case is at the stage of pre-cognizance. In such an event, the first respondent cannot decline to process the petitioner's 2/4

3 W.P.(MD)NO.10816 OF 2022 application. Pendency of criminal case at the FIR stage cannot be an impediment for issuance of passport. Therefore, the first respondent is directed to issue passport to the petitioner within a period of four weeks from the date of receipt of a copy of this order subject to compliance of all the other formalities.
