PRAYER:- Writ Appeal - filed under Clause 15 of Letters Patent Act, to set aside the order passed in W.P.(MD)No.861 of 2025 dated 10.01.2025 on the file of this Court.

JUDGMENT

(Judgment of the Court was made by DR.ANITA SUMANTH, J.) We have heard Mr.K.Abiya, learned counsel for the appellant. 2.The challenge is to an order passed on 10.01.2025 wherein the prayer of R1/writ petitioner was for a mandamus directing the Tahsildar and the Taluk Surveyor of Thirumangalam Taluk to measure land admeasuring 2 acres 67 cents in S.F.No.192/6, No.13, Urappanur Bit-2, Thirumangalam Taluk, Madurai District and fix the boundaries. 3.The present appellant was not arrayed in that writ petition and hence had obtained leave to challenge order dated 10.01.2025. learned Judge in conclusion has noted the submissions of the learned Government Advocate that the survey is to be conducted on 29.01.2025 and has thus closed the writ petition with a direction to the respondents to conduct the survey in accordance with the directions that were issued in order dated 14.06.2024 in WP(MD)No.12676 of 2024. 4.Mr.M.Sarangan, learned Additional Government Pleader for R2 and R3/official respondents confirms that despite the statement of the Government Advocate that the survey was to be conducted on 29.01.2025, nothing has been done thus far.

5.In such circumstances and in order to ensure compliance of the orders of this Court, the survey shall be conducted on 08.10.2025. No notice need be issued to this appellant as the date has been taken note of by learned counsel, who appears for him. Let notice be issued to any other interested parties, in order that they may be present when the survey is conducted.

6.With this, as the grievances of the appellant are duly assuaged, this writ appeal is disposed. No costs. Connected Miscellaneous Petition is closed.
