O R D E R

The wife, who is the respondent in H.M.O.P.No.18 of 2017 seeks transfer of the same from the file of the Sub Court, Pudukkottai, to the file of the Family Court, Madurai.

2. The said H.M.O.P.No.18 of 2017 has been filed by the respondent/husband seeking divorce on the ground of cruelty. The husband though is a permanent resident of Coimbatore, has filed the proceedings before the Sub Court, Pudukkottai, since marriage took place within the jurisdiction of the Sub Court, Pudukkottai.

3. The petitioner wife is a permanent resident of Madurai. It is now learnt that the petitioner is working at Hyderabad. Considering the same, the proceedings in H.M.O.P.No.18 of 2017 are withdrawn from the file of the Sub Court, Pudukkottai and transferred to the file of the Principal Sub Court, Madurai, to be disposed of on merits and in accordance with law. The Sub Court, Pudukkottai, is directed to despatch the records in H.M.O.P.No.18 of 2017 to the Principal Sub court, Madurai, within a period of two weeks from the date of receipt of a copy of this order.

4. Accordingly, this Transfer Civil Miscellaneous Petition is ordered as above. No costs. Consequently, the connected civil miscellaneous petition is closed.
