ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused and he was arrested and remanded to judicial custody on 14.03.2016 for the alleged offences punishable under Sections 465, 467 and 420 of IPC, in Crime No.4 of 2016 on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that the petitioner was working as Manager in the company of the de-facto complainant and has misappropriated Rs.25,640/- given to him for depositing into the bank and subsequently, on verification of the account, it is found that around Rs.40 lakhs have been misappropriated by the petitioner. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. It is further submitted that the petitioner was working as Manager in the company of the de-facto complainant and since, there was some shortage in the company account, the petitioner has been falsely implicated in this case.

4.The learned counsel appearing for the intervener submitted that the de-facto complainant has been carrying out the business in the name Dhanalaxmi Agencies, which has been supplying un-printed Flex Board and related manufacturing materials to the printers in Trichy, Perembalur, Madurai, Pudukottai and Karur for the last ten years and that the petitioner is working as a Manager in Trichy branch office and misappropriated around Rs.40 Lakhs.
5.The learned Government Advocate (Criminal side) appearing for the respondent has submitted that the investigation is in progress and no amount was recovered from the accused so far. 6.Considering the above facts and circumstances of the case and also considering the fact that no amount was recovered from the accused, this court is not inclined to grant bail to the petitioner. Hence, this petition is dismissed.
