For Anticipatory bail in Crime No.67 of 2021 on the file of the Respondent police.

ORDER: The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor (Crl.side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under section 379 of I.P.C r/w 4(1) (1A), 21(1) of Mines and Minerals Development and Regulation Act, 1957 in Crime No.67of 2021 on the file of the respondent police, seeks anticipatory bail.

3. This is the second Anticipatory Bail Application filed by the petitioner on the ground that he has been falsely implicated in this case. Even after a lapse of two months from the date of First https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD. No.7666 of 2021 Information Report, no arrest has been made by the Investigation Officer. Earlier, an Anticipatory Bail Application filed by this petitioner was withdrawn on 20.05.2021.

4. The learned Additional Public Prosecutor (Criminal side) would submit that the petitioner is involved in 14 similar cases of this nature. He is also the owner of a Tipper lorry. Considering the antecedents of the petitioner, who is habitually engaged in such sort of occurrences, he is not entitled for the discretionary relief. Therefore, I find no merit in this petition.
