ORDER

The present Writ of Mandamus to direct the respondents 1 to 3 to enquire and take appropriate action against the respondents 4 to 11 for cheating the petitioner and many others on their Chit Fund Money as represented in petitioner's representation dated 26.07.2023. 2.The learned Government Advocate (Crl.Side) appearing for 2/5

respondents 1 to 3 submitted that there is no such complaint received by them from the petitioner.

3.The accused have collected amount and issued promissory notes. The transaction may not be chit transaction. Hence, this Court is of the considered opinion that even though there is a receipt in the form of promissory note, it amounts to collecting deposit from the poor villages. Therefore, the official respondents shall consider the receipts which is in a form of promissory notes and conduct enquiry.

4.The petitioner is directed to submit a fresh complaint before the 3rd respondent within a period of two weeks from the date of receipt of a copy of this order. Therefore, the official respondents shall conduct proper enquiry and take action as per law.

5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs 06.01.2026 NCC : Yes / No (1/2) Index : Yes / No Internet : Yes TMG 3/5
