Mr.E.Antony Sahaya Prabahar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.122 of 2024 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.122 of 2024, for the offence under Sections 365, 1/3
294(b), 352, 506(ii) and 379 IPC, has filed this petition seeking anticipatory bail.
2. The case of the prosecution is that the petitioner and other accused persons have attacked the defacto complainant and snatched away his cell phone, ATM Card and cash of Rs.250/-
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he has been implicated in this case. He further submitted that the petitioner is ready to co-operate for interrogation.
4. Considering the submissions made by the learned counsel appearing for the petitioner, this Court, by order dated 16.04.2024, granted interim anticipatory bail to the petitioner, enabling him to appear before the respondent Police for interrogation and posted this matter today.
5. Today, when the matter is taken up for consideration, the learned Additional Public Prosecutor submits that the petitioner has not appeared before the respondent Police for interrogation.
6. Considering the conduct of the petitioner in not co-operating with the respondent Police for interrogation, this Court is not inclined to grant anticipatory bail to the petitioner.
