PRAYER :- For Bail in Crime no.1451 of 2020 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 02.10.2020 for the offences punishable under Sections 8(c), 20(b)(ii)(C), 25 and 29 NDPS Act, 1985 in crime No.1451 of 2020 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner and other accused were found in illegal possession of 32 kgs of ganja. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the investigation has been completed and charge sheet also filed in C.C.No.15 of 2021 and the the petitioner is in judicial custody from 02.10.2020, hence he may be granted bail.
4.The learned Government Advocate(Crl.Side) would submit that the petitioner was found in illegal possession of 32 kgs of ganja, https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD)No.7265 of 2021 which is commercial quantity and hence, he strongly opposed this petition.
5.Considering the facts and circumstances of the case and also the fact that the petitioner was found in illegal possession of 32 kgs of ganja, which is commercial quantity, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
