O R D E R

This petition has been filed for a direction to the respondent herein to register the complaint of the petitioner dated 03.04.2016 investigate the same in accordance with law and file final report within a reasonable time.

2. It is seen that this petitioner was an orphan and he was adopted by Mrs.Janagam, who is aged about 65. Janagam was working in the Government Hospital for 30 years and since she did not have a child, she adopted the petitioner. It is alleged by Janagam that after marriage, the petitioner was not taking care of her properly, and even relieved her of her terminal benefits and 10 sovereigns of jewelry. She further stated that on 10.11.2015, when she was sleeping, the petitioner tried to murder her by smothering her with a pillow. On the complaint lodged by Janagam, a case has been registered by the respondent police on 22.01.2016 and this petitioner was arrested and remanded to judicial custody. After the release of the petitioner from the prison, the petitioner has lodged a complaint against his mother on 03.04.2016 alleging that she has taken away his household articles worth Rs.50,000/-.

3. The learned Government Advocate (Crl. Side), on instructions, submitted that the respondent police conducted enquiry and closed the complaint. On a reading of the complaint dated 03.04.2016, this Court finds that the same does lack bonafide.

4. Mr.K.Sivabalan, learned counsel for the petitioner submitted

that this Court may direct the respondent police to atleast get the certificates of the petitioners and his children, which is said to be with his mother Janagam.

5. In the result, this petition is dismissed as devoid of merits. However, the petitioner is at liberty to give a fresh complaint to the respondent police for securing his certificates alone from Janagam and on such complaint being given, the respondent police shall take action in accordance with law.
