For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.172 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner is in custody from 15.04.2021 for the offences under Sections 6, 5(1) of Protection of Children from Sexual Offences Act, 2012 on the file of the respondent police. He seeks bail.

2.The case of the prosecution is that there was a love affair between the petitioner and the victim girl and they have eloped together. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has been falsely implicated in the present case and hence, he seeks bail.

CRL OP(MD). No.7605 of 2021 4.The learned Additional Public Prosecutor, on instructions, would submit that the victim girl is aged about 14 years and she voluntarily appeared before the Investigating Officer and 164 statement was also recorded.

5.Taking into consideration the facts and circumstances of the case and also the fact that the age of the victim girl is 14 years, this Court is not inclined to grant bail to the petitioner, as the investigation is not completed. Hence, this Criminal Original Petition is dismissed.
