ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent Police for the offences under Sections 120 (b), 406, 420, 294(b), 506 (i) of I.P.C. in Crime No.16 of 2018 on the file of the respondent Police.
2.Heard the learned Senior counsel appearing for the petitioners as well as the learned Government Advocate appearing for the respondent and the learned counsel appearing for the intervener. 3.The case of the intervener is that the accused promised to arrange a loan for a sum of Rs.120 Crores. Believing the words of the petitioners, the de facto complainant gave a sum of Rs.73.00/- Lakhs in cash. The petitioners had earlier moved this Court and this Court dismissed their Criminal Original Petition on 07.06.2018.
4.Today, when the matter was taken up for hearing, the learned Senior counsel appearing for the petitioners submits that the entire amount of Rs.73,00,000/- will be deposited by the petitioners to the credit of Crime No.16 of 2018 before the concerned Judicial Magistrate within three weeks. It is needless to say that the disposal of the said amount would depend upon the out come of the https://hcservices.ecourts.gov.in/hcservices/
litigation between the parties. It is made clear that the petitioners shall not approach this Court seeking extension of time for the depositing amount in question.
5.Subject to this condition anticipatory bail is granted to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.1, Tirunelveli and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police for a period of seven days and thereafter as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
