Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order in Na.Ka.No. 1537/I/2021 dated 16.09.2021 passed by the 2nd respondent, quash the same and consequently direct the 3rd respondent to remove the remarks/entries made pursuant to the impugned order which is reflected in the Encumbrance Certificate, and thus render justice. ORDER

The writ petition is filed to quash the impugned order dated 16.09.2021 and direct the 3rd respondent to remove the remarks/entries made pursuant to the impugned order which is reflected in the Encumbrance Certificate.

2. Heard Mr.K.Anbuselvan, learned counsel appearing for the petitioner and Mr.F.Deepak, learned Special Government Pleader, who takes notice on behalf of the respondents 1 to 3.

Upon hearing the learned counsel for the petitioner and perusing the material records of the case, it is seen that the petitioner executed a Settlement Deed dated 16.12.2020 in favour of his daughter. The 4th respondent, being the brother of the petitioner, appears to have submitted an objection. The same has now been rejected by the competent authority, with a direction to the 4th respondent to approach the Civil Court for cancellation of the document. Therefore, the said order is in favour of the petitioner. The only grievance of the petitioner is that these proceedings are reflected in the encumbrance certificate.

In this regard, the learned Special Government Pleader appearing for the respondents 1 to 3 would submit that the encumbrance certificate is intended to reflect all transactions and proceedings relating to the property. It is further submitted that there is no adverse entry or any entry that would cast a cloud on the title of the petitioner. Therefore, the relief sought for by the petitioner cannot be countenanced.

5. Recording the same, the writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. 27.03.2026 NCC:Yes/No rgm
