ORDER

This criminal original petition has been filed seeking a direction to to withdraw the case in Cr.No.19 of 2023 pending on the file of the second respondent and entrust the same to the third respondent for investigation of the case by a competent officer and file a final report, within a time frame.

2.It is seen from the records that the petitioner earlier filed a petition in Crl.O.P.(MD)No.1651 of 2024 seeking a direction to the respondent police to complete the investigation and file a final report, within a time frame. This Court vide order dated 05.02.2024, closed the said petition by recording the submission made by the learned Additional Public Prosecutor that the investigation has almost been completed and final report will be filed within a period of one month. Admittedly, final report has not been filed till now.

3.The learned Government Advocate(Crl.side) appearing for the respondents would submit that the charge sheet will be filed, within a period of one month.

4.The learned counsel appearing for the petitioner would submit that the second respondent has not taken into consideration the main allegation that a woman Constable had affair with the petitioner's husband and that she has already produced photographs to that effect. 5.Considering the submissions made on either side, the second respondent is directed to file a final report, within a period of one month from the date of receipt of a copy of this order. Accordingly, this criminal original petition is disposed of.
