O R D E R

This petition is filed by the petitioner to direct the 2nd respondent to grant permission and police protection for the conduct of temple festival of the temple, namely, "Arulmigu Sri Kaliamman and Sri Karuppasamy Temple" at Thullukutti Nayakanur Village, Peraiyur Taluk, Madurai District, scheduled to be held on 03.04.2025 to 05.04.2025 and also to grant permission to conduct "Aadal Padal program" and "Veerapandiya Kattabomman Nadagam" scheduled to be held on 04.04.2025 and 05.04.2025 in connection with above temple festival.

The learned counsel for the petitioner would submit that the petitioner is a devotee of the deity of Arulmigu Sri Kaliamman and Sri Karuppasamy Temple and the villagers decided to celebrate Panguni festival. Thereby, they fixed the date for the festival from 03.04.2025 to 05.04.2025. For the festival, they decided to conduct Adal Padal and Page No. 2 of 6

Drama (Nadagam) on 04.04.2025 and 05.04.2025. Therefore, they approached the second respondent to grant permission to conduct Adal Padal and Drama and the same was rejected. In the rejection order, the second respondent cited that the cases are pending against some persons and there is a dispute between two individual families. The said reasons are not valid ground to reject the permission to conduct festival and to conduct Adal Padal programme and Drama. Therefore, the order passed by the second respondent is liable to be quashed.

The learned Additional Public Prosecutor (Crl side) for the respondents would submit that the petitioner sent a representation, dated 22.03.2025 for conducting festival and Adal Padal programme and Drama on 04.04.2025 and 05.04.2025 and the same was rejected by the second respondent, through order, dated 23.03.2025 by citing the law and order issue and also two cases were registered against two families. Therefore, the order passed by the second respondent is in order. However, if the petitioner undertakes to conduct festival and Adal Padal and Drama without any law and order issue, they have no objection.

4. Considering the prayer sought for in this petition and the second Page No. 3 of 6

respondent rejected permission to conduct festival and to conduct Adal Padal programme and Drama by citing the reasons that the cases have been registered as against two families. Merely because, two cases registered as against two individual families the second respondent cannot reject the permission to conduct festival and to conduct Adal Padal programme and Drama, which are the cultural programmes. The second respondent ought to have consider the request positively and now, the petitioner also undertakes to conduct festival and Adal Padal programme and Drama, without creating any law and order issue. Therefore, the order passed by the second respondent, by declining the permission, is liable to be quashed.

Accordingly, the order passed by the second respondent is quashed and in view of the same, the petitioner is permitted to conduct festival from 03.04.2025 to 05.04.2025 and also Adal Padal programme and Veerapandia Kattabomman Drama, which are scheduled to be conducted on 04.04.2025 and 05.04.2025. Further, the second respondent is directed to grant adequate police protection and supervise the entire event and the first respondent also directed to monitor the temple festival by giving adequate instructions to his subordinates.
