ORDER

The present petition has been field by the sole accused in C.C.No.7 of 2026 on the file of the District Munsif cum Judicial Magistrate Court, Ilayangudi seeking to quash the charge sheet, wherein the petitioner is alleged to have committed offences under Sections 304(A) of IPC.

2. A perusal of the charge sheet reveals that the deceased was travelling as a pillion rider on a motorcycle driven by the accused to visit a relative who had been admitted to the hospital. While returning back from hospital, due to the negligent driving of the accused, the deceased is said to have fallen down, sustained injury and passed away. Therefore, it is clear that there was no intention on the part of the sole accused to cause the accident. The deceased was carried as a pillion rider on the two-wheeler only for the purpose of visiting their relative who was admitted in the hospital.

3. Pending trial, the parties have entered into a compromise, wherein, the defacto complainant, who is the husband of the deceased had entered into a compromise for quashing the charge sheet. Today, the Defacto-complainant is present and he acknowledges that he had agreed for quashing of the charge sheet.

4. In view of the above, this Criminal Original Petition stands allowed and the charge sheet in C.C.No.7 of 2026 is quashed. The joint compromise memo shall form part and parcel of the order. Consequently, connected miscellaneous petitions are closed.
