Heard the learned counsel on either side.
2. The petitioner is a member of the second respondent Uravinmurai. His grievance is that one Manickam has been appointed as the Correspondent of the school run by Uravinmurai and that the said Manickam has been implicated in two criminal cases.
3. The petitioner invokes Rule 12(5) of Tamil Nadu Recognised Private Schools Regulation Rules. It is seen that only if the person has been convicted, disqualification as set out in the aforesaid rule will apply and not otherwise. The said Manickam has not been convicted and he has only been implicated in the criminal case. Whether to appoint a person who is an accused in a criminal case as Correspondent of the educational institution should be left to Uravinmurai. No mandamus can be issued in such cases.
