CORAM

THE HONOURABLE MR.JUSTICE P.B.BALAJI M.Sagathevan ... Petitioner vs.

1.The District Collector, Sivagangai District.

3.Director of Survey and Settlement, Central Survey Office, Survey House, PWD Estate, Cheppakkam, Triplicane, Chennai 600 005.

... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents 1 - 2 herein to issue patta in petitioner's name thereby, directing the 3rd respondent not to approve the changing of the G-Line, F-Line, and Sub Division Line of the Soorakudi Village in which the Writ Petitioner's property situates.

The petitioner seeks issuance of a Writ of Mandamus to direct the respondents 1 and 2 to issue patta to the petitioner and also seeks a direction to forbear the third respondent from approving any change in G-Line, F-Line, and Sub Division Line of Soorakudi Village. 2.Heard Mr.B.A.Muruganantham, learned Counsel appearing on behalf of the petitioner and Mr.M.Lingadurai, learned Special Government Pleader, appearing on behalf of the respondents. 3.The grievance of the petitioner is that despite having purchased 60 cents of lands in S.No.78/9, Soorakudi Village, in and by a registered sale deed, dated 10.06.2024, the respondents have not acted upon the petitioner's application for issuance of patta, which is pending from 24.06.2024 onwards.

4.The apprehension of the petitioner is that there is a proposal to change the G-Line, F-Line, and Sub Division Line of the Soorakudi Village to accommodate other schemes, which would result in the petitioner being seriously prejudiced.

5.This Court cannot grant the relief, as sought for by the petitioner, especially the second part of the prayer forbearing the second respondent from approving the change in G-Line, F-Line, and Sub Division Line of Soorakudi Village, as long as such change or modification is in accordance with law. However, at the same time, the petitioner's application for issuance of patta, dated 24.06.2024, can also not be kept in the back burner on account of change in G-Line, F-Line, and Sub Division Line of Soorakudi Village. The petitioner's claim for patta is based on the registered sale deed, dated 10.06.2024. The petitioner, without any loss of time, has made an application on 24.06.2024 itself, for issuance of patta.

6.In view of the above, it would suffice to direct the second respondent to pass orders on the petitioner's application for patta on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The Writ Petition is disposed of accordingly. No costs.
