Respondents PRAYER: Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus to direct the first respondent to release the petitioner's Dipper lorry bearing Registration No.TN-67-AE-7436 seized by the second respondent on 04.10.2015 to the petitioner vehicle.

ORDER

The prayer in the Writ Petition is to release the petitioner's Dipper lorry bearing Registration No.TN-67-AE-7436 seized by the second respondent on 04.10.2015 for violating Rule 36(1)(A) of the Tamil Nadu Mines and Minerals Concession Rules, 1959.

2. The learned Government Advocate has produced the order, dated 16.11.2015 imposing penalty of Rs.25,820/- for violating the aforesaid Rule.

3. In these circumstances, the Writ Petition is disposed of directing the first respondent to release the vehicle on payment of Rs.25,820/-, the fine amount imposed in the order, dated 16.11.2015 by the first respondent and release forthwith on payment.
