For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.70 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 21(1) of Mines and Minerals (Development and Regulation) Act 1957 r/w Sections 379 and 353 of IPC in Crime No.70 of 2020, seeks anticipatory bail.
2.The case of the prosecution is that on 07.03.2020, the petitioner and other accused were found in illegal possession of 1⁄2 unit of river sand in TATA Ace vehicle bearing Registration No.TN-20-AU-9749. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.
4.The learned Government Advocate (Criminal side) appearing for the respondent strongly opposed this petition on the ground that https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.7890 of 2021 seven previous cases are pending against the petitioner, which are different in nature.
5.This is the third anticipatory bail application and the earlier petitions were dismissed by this Court on 17.09.2020 and 02.11.2020 in Crl.O.P.(MD)Nos.9921 of 2020 and 12152 of 2020. 6.Considering the facts and circumstances of the case and the fact that the petitioner is involved in illegal transportation of 1⁄2 unit of river sand and also the fact that there is no change in circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner.
