ORDER : The Court Made the following order :- The petitioner is in judicial custody since 09.09.2018 for the offences punishable under Sections 341, 294(b), 307 and 506(ii) I.P.C, in Crime No.323 of 2018 on the file of the respondent police. He seeks bail.

2.The case of the prosecution is that due to previous enimity between the petitioner and the defacto complainant, the petitioner waylaid and abused the defacto complainant and also attacked him with an aruval at that time the defacto complainant escaped from the attack. Thereafter, the defacto complainant lodged a complaint as against the petitioner herein.

3.Heard the learned counsel for the petitioner.

4. The learned Additional Public Prosecutor for the respondent would submit that due to previous motive, the petitioner attacked the defacto complainant with an Aruvan at that time, the defacto complainant escaped from the attack. The petitioner is having four previous cases.

5.Taking note of the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Cheranmahadevi.
