The present petition has been filed to call for the records pertaining to the case registered in First Information Report in Crime No.91 of 2007 on the file of the 1st respondent and quash the same as illegal.

2.When the matter is taken up for hearing today, the learned Government Advocate (Crl.Side) would state that the FIR has been referred as mistake of fact.

3.Recording the above submission made by the learned Government Advocate (Crl.Side) this Criminal Original Petition is closed and the respondent/Police is directed to serve RCS notice to the petitioner forthwith.
