PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to remove the petitioner's name from the History Sheet maintained by the third respondent in H.S.No.133/2020 by considering the petitioner's representation, dated 23.04.2022 within the period that may be stipulated by this Court.

O R D E R

The present Writ Petition has been filed to direct the respondents to remove the petitioner's name from the History Sheet maintained by the third respondent in H.S.No.133/2020 by considering the petitioner's representation, dated 23.04.2022.

2. The learned Counsel appearing for the petitioner would submit that the third respondent police without any reason included the petitioner's name in the history sheet. The petitioner is not a habitual offender involving any breach of peace and law and order problem. W.P(MD)No.10823 of 2022 sheet has been opened in his name. Considering the want of removal of the name, he gave a representation on 23.04.2022 which was not considered as on date. Hence, the present Writ Petition.

3. Mr.M.Sakthi Kumar, the learned Government Advocate (Criminal Side) would submit that the representation of the petitioner is pending before the respondent police.

4. Considering the fact that the representation, dated 23.04.2022, is pending before the third respondent police and also considering the submission of the learned Government Advocate, I hereby direct the third respondent to consider the representation of the petitioner, dated 23.04.2022 within a period of two weeks and pass suitable orders.

5. With this above observations, the Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
