THE HONOURABLE MR.JUSTICE K.RAVICHANDRABAABU W.P(MD)No.21170 of 2015 Subbammal ... Petitioner Vs.

1.The District Collector, Theni District,Theni.

... Respondents Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to survey and place the survey stones in the petitioner property comprised in old Survey No.1424/1 New Survey NO.1570 situated at Keelamuthanampatti, Kovilpatti Village, Andipatti Sub Division, Theni District based on the petitioner's representation dated 26.10.2015.

O R D E R

MrS.Kumar, learned Government Advocate takes notice for the respondents.

2.The petitioner seeks for a mandamus directing the respondent to survey and place the survey stones in the petitioner's property comprised in Old Survey NO.1424/1, New Survey NO.1570 situated at Keelamuthanampatti. Kovilpatti Village, Andipatti Sub Division, Theni District.

3. It appears that the petitioner has made a request for such purpose before the Tahsildar on 26.10.2015. Needless to say that the petitioner is to give sufficient time for the Tahsildar to act on the representation. However, the present writ petition is filed within a month of giving such representation. Therefore, this Court is of the view that in order to give sufficient time to the second respondent, a time frame need not be fixed. However, it is expected that the second respondent to act on the petitioner's representation as expeditiously as possible. If the second respondent has not taken any steps within a reasonable time, the petitioner is at liberty to approach this Court and file a writ petition seeking for further direction.
