ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 465, 468, 471 I.P.C, in Crime No.28 of 2018, seek anticipatory bail. 2.The case of the prosecution is that A3 approached the A1 and A2 and canvassed them for depositing amount in the complainant's bank. The third accused had deposited the huge amount in the name of one Jeyaraj and his wife. The deposited amount was renewed from time to time. In the year 2018, the said deposits were matured and in order to withdraw the same, savings bank accounts were opened in the name of said Jeyaraj and his wife namely Mangalam, S/B A/c.No.8703 and 8704 respectively.

Thereafter, it was found that the said Jeyaraj died as early as on 30.05.2002 and his wife Mangalam died on 05.12.2016 and they are none other than the father and mother of the A1. A1 along with her husband, who is A2 have deposited the said amount in the name of death persons and also opened savings bank accounts in their name and thereafter, the matured amount have been transferred and also withdrawn the same. Hence, the complaint. 3.The learned counsel appearing for the petitioners would submit that the first petitioner is working as the Regional Manager of Pandyan Grama Bank, Thanjavur Region. The second petitioner is working as the Inspector of Brancheds, AIVD department, Pandyan Grama Bank Administrative Office, Virudhunagar. He would further https://hcservices.ecourts.gov.

submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioners. 4.Heard the learned Government Advocate (Criminal Side) for the respondent.

5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.I, Madurai and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
