For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.412 of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 147, 323, 353, 379 IPC r/w Section 21(i) of the Mines and Minerals (Development & Regulations)Act, 1957 in Crime No.412 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner and other accused were said to have illegally transported one unit of river sand in Mini Lorry bearing Registration No.TN 43 A 9876, on 12.11.2020. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case.

4.The learned Government Advocate(Crl.Side) appearing for the respondent police strongly opposed this petition on the ground that the investigation in this case is not completed and the petitioner is having one similar previous case.

CRL OP(MD)No.7687 of 2021 5.The petitioner is alleged to have illegally transported one unit of river sand. Earlier anticipatory bail petition was dismissed on 24.11.2020. Investigation in this case is not completed and there is no change in circumstances since the dismissal of the earlier anticipatory bail petition. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
