PRAYER IN TR CMP(MD)No.208/2016 :
This Petition is filed under Section 24 of the Civil Procedure Code, to withdraw the case in IDOP.No.367 of 2016 from the file of the Family Court, Chennai and transfer the same to the file of the Family Court, Tirunelveli for disposal of the same on merits and in accordance with law and pass such further or other orders. ORDER : This Petition coming on for hearing on this day, upon perusing the petition and upon hearing the arguments of Mr.M.Vijayakumar learned Counsel for the petitioner and the Respondent not appearing either in person or through an Advocate, this Court made the following order :- Notice sent to the address of the respondent namely, S.Shalini, D/o. Stephen Mani, 10-2-57/20, Main Road, Ayikudi, Tenkasi Taluk, Tirunelveli District, is set to have been returned with an endorsement as "left".
It is also stated by the learned Counsel for the petitioner that the respondent is actually residing at S.Shalini, D/O. Stephen Mani, Flat No.21, 2nd Floor, Prayag Apartment, No.15/8, 1st Main Road, Gandhi Nagar, Adayar, Chennai -600 020, and hence, the notice sent to the respondent in the said address also was returned as " left".
2. Therefore, Mr.K.Guru, learned Additional Government Pleader is directed to get a report from the jurisdiction police, namely, Adayar Police Station, Chennai, by giving the following details:- i) whether the respondent is residing in the aforesaid chennai address or not?
ii) whether the respondent has shifted or moved to any place in the new address?

3. Call the matter on 13.02.2017 "for orders."
4. In the meanwhile, the learned Counsel for the petitioner is permitted to serve notice to Mr.M.Shankar, learned Counsel appearing for the respondent about the posting of the matter on 13.02.2017 " for orders".
5. The Registry is directed to print the same of Mr.M.Shankar learned Counsel for the respondent.
