Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st respondent to consider the petitioner's application, dated 05.03.2023 and to disburse the employee benefits of deceased Vijay (petitioner's son) within a stipulated time as may be fixed by this Court.

ORDER

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 1/4

2. This Writ Petition has been filed for Writ of Mandamus, to consider the petitioner's application, dated 05.03.2023 and disburse the deceased employee benefits to the petitioner within a stipulated time that may be fixed by this Court. The deceased employee namely, Vijay is the petitioner's son.

3. It is averred in the writ petition that the 2nd respondent is the employer who had already forwarded the amount to the 1st respondent organization. However, the learned counsel appearing for the 1st respondent submitted that, since there is bereft of the details and particulars, the 1st respondent is not able to trace the same.

4. Therefore, this Court is passing the following order: i. 1st respondent shall approach the 2nd respondent to obtain the details and particulars.

ii. The 2nd respondent is directed to furnish all the details and particulars to the 1st respondent.

iii. Thereafter, the amount shall be disbursed to the petitioner. iv. The respondents shall take necessary steps to disburse the same within a period of eight weeks, from the date of receipt of a copy of the order.

5. With the above observations and directions, this Writ Petition is allowed. There shall be no order as to costs. Index : Yes / No 17.04.2023 Internet : Yes ksa 3/4
