Respondents PRAYER: Writ Petition filed under Article 226 of Constitution of India, for issuance of writ of Mandamus directing the respondent No.1 to 3 to delete the petitioner's name from the History Sheet Register in History Sheet No.242 of 1999 at Inamkulathur Police Station and to withdraw the case under Section 109 I.P.C. which was pending in Crime No.55 of 2008 of Inamkulathur Police Station and consequently, to pay to the petitioner, compensation of a sum of Rs.1,00,000/-.

ORDER

This writ petition is filed for a writ of mandamus directing the respondents 1 to 3 to delete the petitioner's name from the History Sheet Register in History Sheet No.242 of 1999 at Inamkulathur Police Station, Tiruchirappalli District and to withdraw the case under Section 109 IPC which was pending in Crime No.55 of 2008 on the Inamkulathur Police Station and also for consequential compensation.

2.Today when the matter is taken up for hearing, the learned Additional Public Prosecutor produced the proceedings of the Inspector of Police, dated 15.12.2015, wherein the Inspector of Police, Ramjinagar Circle, Tiruchirappalli District, has made recommendation to the Deputy Superintendent of Police that the petitioner is living with his wife and children peacefully for the past ten years and running a sweet stall for eking his livelihood. He was under surveillance for the past ten years and during the surveillance, there is no complaint what so ever as against the petitioner. By taking into consideration of the recommendations, the Deputy Superintendent of Police, Jiapuram Sub Division, Tiruchirappalli District, by his proceedings in e.f.vz;/533-f.J.f.m. [P /15, dated 15.12.2015, has also closed the History Sheet No.242 of 1999.

3.In view of the submissions made by the learned Additional Public Prosecutor, nothing survives for adjudication in this petition. Accordingly, this writ petition is closed as no further order is required. No costs.
