O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus directing the respondents herein to appoint a surveyor and conduct a survey of the land comprised in Old Survey No. 502, New Patta No. 2482, Old Patta No. 209, situated at Vilpatti Village, Kodaikanal Taluk, Kodaikanal, Dindigul District, measuring an extent of 67 acres and 58 cents, falling within the Sub-Registration District of Kodaikanal and the Registration District of Dindigul, in accordance with the application submitted by the petitioner vide receipt No. 20221102005420 dated 02.11.2022.

2.Heard the learned counsel for the parties.

3.The learned counsel for the petitioner submits that an application dated 02.11.2022 was made seeking survey and demarcation of the boundaries of the property in question. Since no action has been taken by the respondents, the present writ petition has been filed.

4. The learned Government Advocate appearing for the respondents submits that after considering the claims of all parties, proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

In view of the above, this Court directs the second respondent/Tahsildar to consider and dispose of the petitioner's application dated 02.11.2022 for survey and demarcation on merits and in accordance with law. Notice shall be issued to the petitioner and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of sixteen weeks from the date of receipt of a copy of this order. In the event of any rival claims, the same 3/6
