ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 406, 420, 468 and 471 I.P.C., and Section 5 of TNPID Act 1997, in Crime No.1013 of 2012, on the file of the respondent police seeks anticipatory bail.

2.It is submitted by the learned counsel for the petitioner that the petitioner is an innocent person and he has not committed any offence and a false case has been foisted against him. 3.The learned Government Advocate (Crl.side) submitted that non bailable warrant was issued against the petitioner on 22.03.2016 by the TNPID Court, Madurai and the same is pending and hence, he prays for dismissal of this petition.

4. I have considered the rival submissions and perused the typedset of papers. 5.Considering the facts and circumstances of the case and also considering the fact that the case has been registered in Crime No.1013 https://hcservices.ecourts.gov.in/hcservices/ of 2012 and charge sheet has been filed and taken on file before the

TNPID Court, Madurai and Non-Bailable Warrant has been issued against the petitioner on 22.03.2016, I am not inclined to grant anticipatory bail to the petitioner. However, the petitioner is directed to surrender before the Magistrate concerned, within a period of one week from the date of receipt of a copy of this order and file an application to recall the warrant and on such application being filed, the Magistrate concerned shall pass orders on merits and in accordance with law on the same day itself, after issuing notice to the learned Public Prosecutor. sd/- 22/04/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
