Respondents PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a writ of Mandamus, directing the third respondent to comply with the order passed by the second respondent in his proceedings in Na.Ka.No.911/A4/2021, dated 19.02.2021 within the stipulated time as fixed by this Court.

ORDER

[Order of the Court was made by T.S.SIVAGNANAM, J.] Heard Mr.C.Mayilvahana Rajendran, learned counsel appearing for the petitioner and Mr.R.Baskaran, learned Government Counsel for

the respondents 1 to 3.

2. With the consent on either side, the writ petition is taken up for final hearing at the time of admission itself.

3. In the light of the directions we propose to issue in this writ petition, notice to the fourth respondent is dispensed with.

4. The petitioner seeks for a direction upon the third respondent to complete the enquiry, which has been directed to be conducted by the second respondent vide proceedings dated 19.02.2021, within a stipulated time.

5. The learned Government Counsel appearing on behalf of the respondents 1 to 3 submitted that already steps have been initiated to commence and conduct enquiry and the Authorities require four weeks time to do so.

6. In the light of the said submission made on behalf of the respondents 2 and 3, we direct the third respondent to commence and complete the enquiry in terms of the directions issued by the second respondent vide proceedings dated 19.02.2021 and conclude the same not later than 15.07.2021 and submit a report to the second respondent with due intimation to the writ petitioner. We make it clear that before commencing the enquiry, notice should be issued to the fourth respondent as well as to the writ petitioner.

7. With the above directions, the writ petition is disposed of.
