Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498 (A), and 294 (b) IPC in Crime No.49 of 2018, seek anticipatory bail. 2.The case of the prosecution is that the first petitioner is the husband of the defacto complainant and working as Grade II Police in Armed Force and married the defacto complainant. The defacto complainant lodged a complaint on the allegation that on 25.03.

2018 the first petitioner used filthy language in front of the defacto complainant's relatives and the petitioners 2 and 3 are supported to the first petitioner. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the first petitioner filed a divorce petition in H.M.O.P.No.148 of 2018 on the file of the family Court. After receiving the summon from the divorce petition, the present complaint has been made as against the petitioners.

5.Considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Additional Mahila Judge, Madurai, and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the first petitioner shall appear before the respondent police for a period of two weeks and thereafter as and when required for interrogation. The petitioners 2 and 3 shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
