PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 to 3 herein to close the CSS Poultry Farm situated at Kuppam Village, Karungalkattil, Karur District and also to take necessary action against the fourth respondent by considering the petitioner's representation dated 24.05.2021 within the time stipulated by this Court. (Order of the Court was made by G.ARUL MURUGAN, J.) The Writ Petition is filed seeking for a direction to the respondents 1 to 3 to close the CSS Poultry Farm established by the fourth respondent.

2.It is now brought to the notice of this Court that the fourth respondent has applied for consent before the Tamil Nadu Pollution Control Board. The District Environmental Engineer, Tamil Nadu Pollution Control Board, Karur, vide proceedings dated 17.08.2024, has renewed the consent order under Section 25 of the Water (Prevention and Control of Pollution) Act, 1974. The renewed consent is valid till March 31, 2032. 3.The fourth respondent has established the Poultry Farm after obtaining valid consent from the Tamil Nadu Pollution Control Board and such consent has been duly renewed.

4.Since the consent is valid till March 31, 2032, the present Writ Petition filed by the petitioner, seeking a direction to close the poultry farm run by the fourth respondent, is not maintainable. If at all the petitioner is aggrieved by the consent granted by the Tamil Nadu Pollution Control Board, it is open to him to initiate appropriate proceedings before the Appellate Authority, in the manner known to law. 3/6
