Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing 5th and 6th respondents to grant petitioner's salary for the month of February 2012, 01.02.2013 and for the period from 26.4.2013 to 30.04.2013 by implementing the order passed by 3rd respondent vide his proceeding in R.C.No.3208/12-A4 dated 10.07.2015 within the period that may be stipulated by this Court. ORDER
The petitioner's salary for the month of February, 2012 as well as for the period from 26.4.2013 to 30.04.2013 was not paid, owing to his non-submission of his income tax returns. Subsequently, when the petitioner had submitted his returns, sanction was accorded for claiming the unpaid salaries by the Tahsildar, Pattukkottai, through his proceedings dated 10.07.2015. 2/4
2.Since the Tahsildar had accorded sanction for claiming the petitioner's unpaid salary, there may not be any impediment for the sixth respondent to disburse the unpaid salaries.
3.Accordingly, the petitioner is granted liberty to give a representation before the sixth respondent herein including the copy of the recommendation made by the Tahsildar, Pattukkottai, and on receipt of the same, the sixth respondent herein shall pass necessary orders, for payment of the petitioner's unpaid salary for the month of February, 2012, as well as for the period from 26.4.2013 to 30.04.2013. Such orders shall be passed within a period of six (6) weeks from the date of receipt of a copy of the petitioner's representation. This Writ Petition stands disposed of accordingly.
