PRAYER: Writ Petition filed under Article 226 of the constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the Second Respondent in his proceedings in R.No.8736/E5/A2/2012 dated 14.07.2018 and quash the same as illegal and consequently to direct the Respondents 1 and 2 to regularise the service of the Petitioner and revise the scale of pay on par with similarly placed Assistant Surgeons within the period that may be stipulated by this Court.

ORDER

(through video conference) Mr.P.Thilak Kumar, Learned Counsel on behalf of Government of Tamil Nadu takes notice for the Respondents and pointed out that the Petitioner has already filed another Writ Petition challenging the same impugned order in W.P. (MD) No. 18272 of 2018. 2.

In view of the same, Learned Senior Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition and informs that a memo through e-mail would be filed to that effect, which shall be placed on record.

In the result, the Writ Petition is dismissed as withdrawn. Consequently, the connected miscellaneous petitions are closed. No costs.
