O R D E R

This Writ Petition is filed for a mandamus directing the second respondent to register the certified copy of the decree dated 21.08.2008 passed in O.S. No. 605 of 2008 on the file of the Principal District Munsif Court, Madurai Town, on payment of registration charges alone, without insisting on payment of any stamp duty and without insisting on Page No. 2 of 6

compliance with the period of limitation under Section 23 of the Registration Act, 1908.

2. According to the learned counsel for the petitioner, when the petitioner sought to present the said document for registration, the same was orally refused to be received on the ground that the petitioner should pay stamp duty. It is the case of the petitioner that she is not liable to pay the stamp duty as claimed by the Sub-Registrar.

3. The learned Additional Government Pleader, taking notice on behalf of the respondents, would submit that the document itself has not been produced for registration and that if and when the same is produced, orders will be passed in accordance with law.

4. In view thereof, this Writ Petition is disposed of on the following terms:

i. By following the usual procedure of obtaining an appointment, the petitioner shall present the document for registration. Page No. 3 of 6

ii. As and when the same is presented for registration, it is open to the second respondent to process one same and pass orders thereon in accordance with law.

iii. No costs.
