PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the Impugned order issued by the 1st respondent through proceedings in Na.Ka.No.3607104/2025/J3 dated 31.12.2025 issued by 1/5

the 1st Respondent and quash the same as illegal and consequently directing the respondents not to demolish the house of the petitioner bearing Survey No.174/17 situated at Chockkadevanpatti, Adi-dravidar Colony, Usilampatti Taluk, Madurai District.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed this writ petition seeking to quash the impugned order issued by the first respondent in proceedings Na.Ka.No. 3607104/2025/J3 dated 31.12.2025 and consequently to direct the respondents not to demolish the petitioner's house bearing Survey No. 174/17, situated at Chockkadevanpatti, Adi-Dravidar Colony, Usilampatti Taluk, Madurai District.

2. Mr. A. Kannan, learned Additional Government Pleader, accepts notice on behalf of the respondents.

3. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission.

4. The learned Additional Government Pleader appearing for the respondents submitted that the petitioner has an alternative remedy of filing a revision under Section 10-A of the Tamil Nadu Land Encroachment Act before the competent authority.

5. We are of the view that the writ petition cannot be entertained in view of the availability of an alternative remedy. Accordingly, the writ petition is dismissed. However, the petitioner is at liberty to file a revision under Section 10-A of the Tamil Nadu Land Encroachment Act before the appropriate authority and seek interim relief, if so advised. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
