ORDER : The Court Made the following order :- The petitioner is in judicial custody since 15.05.2017 for the offences punishable under Sections 8(c) r/w 22 (c) of NDPS Act, 1985, in Crime No.136 of 2017 on the file of the respondent police. He seeks bail.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.The case of the prosecution is that on 13.05.2017, on information, the respondent police and his team intercepted the accused vehicle. At that time, except the first accused, other accused including this petitioner flew away from the place of occurrence. Thereafter, the respondent seized 560 grams of Diazepam powder and it is a commercial quantity. Hence a case has been registered.

4.The learned counsel for the petitioner would submit that the petitioner is arraigned as A2 and other accused persons were already released on bail. Further he submitted that he is suffering from paralysis attack and he is taking treatment in the Government Hospital, Trichy.

5.The learned Additional Public Prosecutor also reported that the petitioner is taking treatment at the Government Hospital, Trichy for paralysis attack.

5.Considering the above facts and circumstances of this case and the health condition of the petitioner and also other petitioner are released on bail, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Additional District and Sessions Judge, Special Court under EC Act cases, Thanjavur.

(ii)the petitioner shall appear before the respondent police once in a week until further orders.
