C-60.To modify the order dated 19.12.2025 passed in Crl OP(MD) No.23652/2025, to the effect by enabling the petitioners to undertake the process of renovation of existing Pedams in Kallavandan Swamy Temple situated at West of Tenkasi Road, Opp to Ananda

ORDER

The learned counsel for the petitioner brought to the notice of this Court that since a specific mention as to the reconstruction of the existing Pedam is not found in the order passed by this Court on 19.12.2025, the respondent police is not permitting him to reconstruct the same and sought a modification in this regard.

2. In view of the above, the order passed by this Court in Crl.O.P(MD)No.23652 of 2025, dated 19.12.2025 in Paragraph No.4 is modified as follows : "Considering that the petitioners have obtained a decree in their favour, and that the third respondent's rights have already been restricted to the right of worship by the learned District Munsif Court, Srivilliputtur, the second respondent police is directed to protect the petitioners in carrying out the construction of the compound wall and reconstruction of the existing Pedam, until its completion. The petitioners shall also be liable to pay the necessary charges for availing police protection, and the respondent police is directed

to provide the required protection upon receipt of such payment. Accordingly, this Criminal Original Petition stands disposed of."

3. Accordingly, this petition is ordered.
