ORDER

This Criminal Original Petition has been filed for issuing a direction to transfer the investigation on the petitioner's complaint, dated 10.03.2023 on the file of the 2nd respondent, to any other competent officer to conduct further investigation in accordance with law within a stipulated time as may be fixed by this Court.

2. Heard the learned learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The grievance of the petitioner is that the private respondents trespassed into the house of the petitioner and caused damage to the properties. According to her, cognizable offence has been made out, over which, the complaint has been given, enquiry has not been made so far. The petitioner has stated that even though there is a damage to the property it was not properly enquired. 2/5

4. On perusal of the CD file it is seen that it is a issue between petitioner and her sister viz., third respondent, with regard to title over the sale deed. It is also seen that no spot visit has been undertaken by the respondent police.

5. Let the above said complaint be enquired in a proper manner by the second second respondent and the enquiry will be completed within a period of 15 days from the date of receipt of a copy of this order. There is no question of transfer of enquiry and accordingly, this Criminal Original Petition is disposed of. 12.04.2023 NCC :
